Turtle Derby on the Delta

 

Official Rules & Regulations

The race is presented by Covenant Hospice (“Presenter”) to benefit its mission of providing end-of-life care for patients with life-limiting illnesses regardless of ability to pay.  It is a 501 (c)3 Tax Exempt Charity (Tax I.D.59-2208300).

 

    • A maximum of 1,000 turtles will be entered in the race.
    • Turtles will be launched into Sardine Pass at Five Rivers Delta Resource Center at approximately 4:30 pm on Sunday, September 19, 2010. The Presenter will establish the race course. The Presenter reserves the right to postpone or reschedule the Race, or to determine a winner by random drawing, in the event of inclement weather, acts of God or other circumstances beyond the Presenter’s reasonable control.
    • Once the turtles are launched, they are on their own. No attempt to free or interfere with any turtle is permitted, unless deemed necessary by the Presenter. The Presenter reserves the right to manually maneuver turtles while on the race course.
    • All turtles entered will be provided by the Presenter and shall remain the property of the Presenter.
    • A number will be attached to each racing turtle corresponding to the number on an adoption paper. Prizes will be awarded to the holder of each entry adoption paper in the order the winning turtles cross the finish line. Prizes are non-transferable. If the person listed on the adoption papers is a minor, his/her legal guardian may claim the prize on behalf of said minor upon proof of identity and relationship. 
    • Entrants need not be present to win.  All prizes must be claimed from the Presenter within thirty (30) days after September 19, 2010, and are subject to vendor expiration dates.  For unclaimed prizes, the Presenter reserves the right to select a winner by random drawing of entries.  All prizes will be awarded according to contest rules.  Prizes will not be mailed or shipped but must be picked up at the address below. A list of prizes and winners can be obtained from the Presenter by sending a written request therefore, and a self-addressed, stamped return envelope to: Turtle Derby on the Delta, 3201 Dauphin St., Suite D, Mobile, AL 36606. Winners will also be on the Presenter’s event website at www.covenanthospice.org.
    • The Presenter reserves the right to limit the number of adoptions per individual.
    • The entry portion of each chance adoption paper must be completely filled out and delivered to Presenter prior to the race; or the entry portion of the adoption paper can be mailed to Presenter at the address above and must be received by Presenter by 1pm on Friday, September 17, 2010 or purchased between 2:30 pm and 4:00pm on Race Day at Five Rivers on September 19, 2010 for a chance to be eligible to win any prize. No other adoption papers are eligible to win any prize. Entrants assume the risk of non-delivery of any entries to Presenter or an authorized representative of Presenter.
    • A donation of $5 per turtle adoption is suggested to benefit Covenant Hospice.  No purchase is necessary to win.  A turtle can be obtained by presenting a written request in person at the Covenant Hospice office, 3201 Dauphin St., Suite D, Mobile, Alabama, between the hours of 9am and 4pm Monday thru Friday until September 17, 2010.  Mailed entries received after September 17, 2010 at Noon CDT will be deemed a donation only and will not be in the race.  In-person adoptions may be accepted up to 4 pm CDT on September 17, 2010 at the office.  Day of race adoptions may be accepted from 2:30 to 4:00 p.m. CDT on September 19, 2010 at designated site on race course.
    • Winners will be announced at Five Rivers after the completion of the race and tabulation of the results. Entrants do not need to be present to win a prize. Winners will be notified by U.S. Mail or by telephone. A list of winners will be available by written request to Covenant Hospice at the address above or on the Presenter’s event website at www.covenanthospice.org. Prizes must be claimed by October 19, 2010.
    • No cash equivalent prizes will be provided in lieu of the designated prizes. Winners shall be responsible for the payment of federal income tax withholding, if any, on all prizes for which income taxes must be withheld prior to delivery of the prize to the winner.
    • Excess turtles (not adopted) may be launched into the Race. If excess turtles are launched in the Turtle Derby, and the first turtle to cross the finish line is an excess turtle, the Grand Prize will be awarded to the adopter of the first-adopted turtle to cross the finish line thereafter. The remaining smaller prizes will likewise be awarded in similar fashion.
    • By entering, entrant’s release Presenter and its members, agents, employees, supporters, volunteers, Five Rivers and the various organizations involved in the presentation and completion of the race from any and all liability with respect to prizes.
    • By entering, winners consent to the promotional use of their names and likenesses without additional compensation.
    • Chances of winning depend on the total number of qualified entries.
    • This event is subject to all federal, state and local laws and regulations and is void where prohibited by law.
    • Turtle logos and likenesses are registered trademarks of Great American Duck Races, Inc. and no other person or entity is authorized to copy or otherwise use them without the expressed written consent of Great American Duck Races, Inc.
